About the Course
This course provides a comprehensive study of Labour Law based strictly on its constitutional, statutory, and regulatory framework. It begins with an examination of the constitutional philosophy of labour law, highlighting labour as a subject under the Concurrent List and analysing the legislative competence of the Centre and the States. The course explores the role of labour laws in achieving social justice and strengthening the welfare state through the study of Fundamental Rights and Directive Principles such as equality before law, non-discrimination in employment, freedom of association, right to livelihood, prohibition of forced and child labour, equal pay for equal work, living wages, and humane conditions of work.
The syllabus further introduces international labour standards through the structure and functioning of the International Labour Organization (ILO), its tripartite system, conventions, recommendations, and core labour standards, along with India’s relationship with the ILO. It covers the law of wages, focusing on wage fixation, non-payment, deductions, bonus, and equal remuneration under key legislations. The course also addresses health, safety, and working conditions, employer liability, occupational hazards, and compensation mechanisms.
In addition, the course examines social security and welfare legislations, industrial relations, collective bargaining, and trade union laws. Contemporary issues such as gender discrimination, workplace sexual harassment, emerging forms of employment, and child labour law reforms are also critically analysed, providing a well-rounded understanding of labour law in India.
